heal.abstractIn this paper we discuss the Imperial laws concerning marriage in Byzantium and all the relevant matters, such as engagements, divorces etc. We also examine the increasing involvement of the Orthodox Church in these affairs. In particular we examine these issues in thirteenth century Epirus, mainly through the surviving synodical decisions of John Apokaukos. The results obtained in this brief examination indicate that the Byzantine society of this province, which after the cataclysm of 1204 was raised to power within the “Epirotan State”, was in close collaboration with the Church. People brought their cases concernig marriage problems before the metropolitan synod of Naupaktos after the decline of the secular authorities. The decisions taken were based not only upon the Imperial laws but also on the Byzantine “oikonomia”. Thus ecclesiastical penalties and the complicated decrees of the Imperial laws on these difficult matters were used concurrently by John Apokaukos and the other bishops on Epiros in an effort of the Church to fill in the vacuum of secular authorities and at the same time to understand and solve the problems of their society.en
