| heal.abstract | Αξιοποιώντας το πολυπληθές αρχειακό υλικό των αρχείων της Κέρκυρας, μελετήθηκε ο τρόπος εφαρμογής των κανόνων δικαίου κατά τη διαδικασία επίλυσης διαφορών. Eίναι γνωστό ότι η Κέρκυρα, εξαιτίας της σπουδαίας γεωπολιτικής της θέσης, υπήρξε σημαντικότατος χώρος τέτοιων εξελίξεων. O τελευταίος αιώνας της βενετικής κυριαρχίας και ο αμέσως επόμενος χαρακτηρίζονται από πλήθος μεταβολών ως απόρροια των γενικότερων πολιτικών, οικονομικών και κοινωνικών αλλαγών. Ωστόσο, οι πρακτικές της διαμεσολάβησης και του διακανονισμού, καθώς και ο θεσμός της διαιτησίας εμφανίζουν μικρές διαφοροποιήσεις, με την επισήμανση των αστικών χαρακτηριστικών των οικονομικών δραστηριοτήτων, οι οποίες πλαισιώνονται και τεκμηριώνονται με την εφαρμογή κανόνων του γραπτού και του εθιμικού δικαίου. Στην υπό εξέταση χρονική περίοδο, το ενδιαφέρον εστιάζεται στην εξωδικαστική επίλυση των διαφορών όπως αυτή υπαγορευόταν κυρίως από την ανάγκη των αντιδίκων για γρήγορη διευθέτηση των υποθέσεών τους, καθώς και για την αποφυγή των ενίοτε υψηλών δικαστικών εξόδων. Οι τρόποι επίλυσης των διαφορών, εκτός του πλαισίου υπαγωγής τους στη δικαστική εξουσία, ήταν η διευθέτηση διαφορών από τους άμεσα ενδιαφερομένους, η διαμεσολάβηση μέσω άτυπων κριτών και η προσφυγή στη διαιτησία (αιρετοκρισία), περιβαλλόμενοι βεβαίως και οι τρεις τρόποι με το κύρος της συμβολαιογραφικής πράξης. Αξιοσημείωτος ο ρόλος του συμβολαιογράφου, αφού καθίστατο σημαντικότατος φορέας εφαρμογής γραπτού και εθιμικού δικαίου. Οι προς επίλυση υποθέσεις αφορούν θέματα σχεδόν όλων των κλάδων του αστικού δικαίου (ενοχικό, εμπράγματο, κληρονομικό, οικογενειακό και εμπορικό δίκαιο). Για παράδειγμα, καταγράφονται προς επίλυση διενέξεις και αντιδικίες σε εμπορικές εταιρείες (αξιοποίηση κεφαλαίων, καταμερισμός κερδών), μεταβιβάσεις κυριότητας, δανεισμοί, συμβάσεις έργου, ενεχυριάσεις, μισθώσεις, προικώα και κληρονομίες. Η διαιτητική διαδικασία περιελάμβανε τη σύναψη συνυποσχετικού, δυνάμει του οποίου γινόταν η εκλογή των κριτών με δεδηλωμένη τη βούληση των αντιδίκων για επίλυση της διαφοράς. Οι αντίδικοι, στο πλαίσιο εφαρμογής του περί δικαίου αισθήματος, αποδέχονται και δεσμεύονται για την εφαρμογή των διαιτητικών αποφάσεων, οι οποίες ήταν ανέκκλητες. Οι κριτές είχαν ανώτερη κοινωνική καταγωγή και, ως επί το πλείστον, ήταν άτομα εγνωσμένου κύρους, ενώ δεν ήταν λίγες οι φορές, κατά τις οποίες λειτουργούσαν και ως διαμεσολαβητές ή ζητούσαν την αρωγή εκτιμητών, ειδικών εμπειρογνωμόνων. Στο πλαίσιο της επίλυσης των διαφορών, συχνά υιοθετείται ένας συνδυασμός επιλογών, πάντοτε βάσει των συναλλακτικών ηθών της εποχής και στο πλαίσιο της εφαρμογής των κανόνων και των αρχών του δικαίου, που ίσχυαν στην Κέρκυρα κατά τον 18ο και τον 19ο αιώνα. | el |
| heal.abstract | This study examines the ways that the rules of law were applied during the dispute of resolution. Thus, there was conducted an extensive research of the multitudinous archival material of the Corfu archives. It is well known that Corfu was considered as a very significant place of such developments due to its major geopolitical location. The latest century of the Venetian domination and the next century were characterized by a number of changes as a result of the general political, economic and social changes, nevertheless, the institution of arbitration and mediation seems to differ slightly. We point out the urban characteristics of economic activities, which are framed and documented by the application of rules of written and common law. The main interest at this specific time period is focused on the extrajudicial dispute resolutions at Corfu. This period was mainly characterized as a period where every citizen required a quick solution for his cases, as well as avoidance of unnecessary court costs. Consequently, citizens of Corfu used to prefer alternative ways of resolving their differences, such as direct resolution of those who were involved at the dispute, the mediation through non elected arbitrators and the recourse to arbitration, bounded by the authority of a notarization. The notary turned out to have a great part on these kinds of conflicts, that is, it became very important implementer of written and common law. Plenty of different cases have been recorded for resolution in Corfu and concern issues of almost all branches of civil law (debt, property, inheritance, family and commercial law). For example, disputes are recorded in commercial companies (capital utilization, profit sharing), transfer of ownership, loans, works contracts, pledges, leases, dowries and bequests. The resolution of dispute took place after a very specific process which contained the conclusion of a compromise agreement which contained the election of arbitrators and the will of the parties for the resolution of disputes. In fact, the opponents seeking different ways to satisfy the sense of justice, accepted and committed for the implementation of the arbitrators’ decisions, which were irreversible. It is worth noting that they were of a higher social descent, thus they were mainly men of recognized status. Indeed, many were the times when they were acting as mediators or asking the help of valuators for providing a fairer justice. For the settlement of disputes, they adopt a combination of choices, always based on the fair merchantable quality of the time and in the context of respecting the principles of law which were in force in Corfu during the 18th and 19th centuries. | en |
